JAGMEDIA TERMS:
Fee is payable prior to project start. Project to commence upon Receipt of Fee by Jagmedia. Fee is Non-Refundable. Receipt of fee by Jagmedia constitutes acceptance of Terms by Client. Remaining Balance due prior to file release to Client and according to payment schedule set forth on Order Form (where applicable). File release indicates files transferred to client electronically. The remainder of the balance due upon scheduled payment date as determined by Jagmedia and prior to file transfer to Client. This includes fees for additional services requested by client. Invoices will be sent via email to client.

Cancellation Policy
Cancellation of services at the request of the Client must be made by Phone call to 310-823-7486 (between 9am-6pm PST) within 48 hours of payment. A $150.00 cancellation fee will be charged and work performed will be billed for on an hourly basis of $100 per hour. In the event this amount is not sufficient to cover Jagmedia for time ($100 per hour), and expense already invested in the project additional payment will be due. If additional payment is due, this will be billed to the Client within 48 hours of notification to stop work. Final payment is due within 48 hours of final email invoice date. ALL files remain property of Jagmedia and will NOT be released to Client as a result of cancellation for any reason.

Liability
The Client represents to Jagmedia and unconditionally guarantees that any elements of text, graphics, photos, designs, trademarks, or other Artwork furnished to Jagmedia for inclusion in the Client’s web site are owned by the Client, or that the Client has permission from the rightful owner to use each of these elements, and will hold harmless, protect, and defend Jagmedia and its subcontractors from any claim or suit arising from the use of such elements furnished by the Client.

Arbitration
You and we agree to submit any dispute arising under this agreement, except a dispute alleging criminal violations, to binding arbitration in Santa Monica, CA using a professional arbitrator to render a decision based upon fairness, not necessarily upon legal principles, but it will be binding on both of us. Judgment on the decision may be entered in any court having jurisdiction. This agreement to arbitrate affects important legal rights. Neither of us will be able to go to court for disputes once we agree in advance to arbitrate.
